Fatal accident inquiry to be held into death of pedestrian hit by Edinburgh tram | UK News

A fatal accident inquiry is to be held into the death of a pedestrian who was hit by an Edinburgh tram on his way home from work.

Bus driver Carlos Hernan Correa Palacio, 53, died after he was struck at a crossing in the Saughton area of the capital on 11 September 2018.

Edinburgh Trams Limited (ETL) was fined £240,000 last year after admitting a breach of health and safety legislation over the incident in a hearing at Edinburgh Sheriff Court.

The court heard how the driver sounded his bell a number of times and began to slow the tram down when he spotted Mr Correa.

He applied the emergency brake, which also set off the tram’s warning horn, but Mr Correa was killed.

The Crown Office said there were no issues with the tram driver and he had responded to the situation in accordance with his training.

The tram was in working order and the braking system functional.

Prosecutors said there had been no assessment of a foreseeable risk to pedestrians at the Saughton Mains crossing from an approaching tram prior to the incident, despite a near miss in November 2016.

ETL failed to carry out a sufficient risk assessment of the layout of the crossing, and to ensure it provided sufficient notice and warning to pedestrians, the court heard.

The company also failed to assess the loudness of audible warning devices, or the emergency braking distances of trams approaching the crossing.

The Crown Office and Procurator Fiscal Service (COPFS) has now lodged a first notice to begin the court process for a fatal accident inquiry (FAI) into Mr Correa’s death.

The purpose of an FAI includes determining the cause of death, the circumstances in which the death occurred, and establishing what, if any, reasonable precautions could have been taken, and could be implemented in the future, to minimise the risk of future deaths in similar circumstances.

The FAI will explore the circumstances of Mr Correa’s death, with a focus on the process of risk assessment and safety management at ETL.

Issues surrounding pedestrian safety at non-motorised user (NMU) crossings and an assessment of the audibility of warning systems fitted to ETL trams will also be looked at.

The inquiry is also expected to consider the structure for oversight and information sharing within the tram sector, including among regulators, operators, and other interested parties.

Unlike criminal proceedings, FAIs are inquisitorial in nature, and are used to establish facts rather than to apportion blame.

Procurator Fiscal Andy Shanks, who leads on death investigations for COPFS, said: “The tragic death of Carlos Correa occurred in circumstances giving rise to significant public concern and as such a discretionary fatal accident inquiry will be held.

“The lodging of the first notice enables FAI proceedings to commence under the direction of the sheriff.

“Mr Correa’s family will continue to be kept informed of significant developments as court proceedings progress.” 

A preliminary hearing will take place on 31 May at Edinburgh Sheriff Court.

Two teenagers have been jailed after being found guilty of the manslaughter of a 14-year-old boy.

Gordon Gault was stabbed on the arm with a machete as he rode on the back of a friend’s e-bike in Newcastle’s West End in November 2022. He died six days later in hospital.

The deadly attack, which also saw one of his associates slashed in the back, broke out when two rival gangs went out looking for each other.

Six teenagers went on trial at Newcastle Crown Court and were cleared of murder, but Carlos Neto, 18, of Salford, Greater Manchester, and Lawson Natty, 18, of Newbiggin Hall, Newcastle, were convicted of manslaughter.

Neto stabbed the 14-year-old, jurors heard, while Natty was the one who supplied him with the machete he had bought online.

Mr Justice Martin Spencer sentenced Neto to nine years and two months while Natty, who was born in Belgium, was sentenced to 32 months, after which he could face deportation.

The attack was the culmination of an escalating tit-for-tat exchange of violence between the two gangs.

It had begun with a rival making a “diss track” making fun of Natty’s appearance, the court heard.

Neto led a group of six to infiltrate Elswick Park, where they were spotted by a larger group of rivals, causing them to retreat.

Gordon, armed with a baseball bat, was stabbed as he was isolated riding on the back of a friend’s speedy e-bike, then a separate clash followed in a nearby street.

During the sentencing, the judge also criticised drill music as a “pernicious genre” that he said “tends to glorify violence”.

Neto said he was inspired by rappers and their lifestyle, their money, fame, cars and watches.

He liked the rappers’ masculine image and the respect they earned, telling jurors during his trial: “Without these things, my chances of success were zero.”

“You still have a future,” Mr Justice Spencer told Neto. “Sadly, Gordon Gault does not.”

Gordon’s mother wept as she read a statement out in court, urging people not to carry knives.

“The devastation your actions cause is unimaginable.”

Gordon’s grandmother Frances Gault referred to offensive raps and remarks Neto made after the killing.

She said: “Mocking him and gloating about these actions absolutely crushed me.

“No remorse has ever been shown and I can never forgive this.”

Woman, 30, arrested over fatal stabbing in Enfield, north London | UK News

A 30-year-old woman has been arrested on suspicion of murder following a fatal stabbing in Enfield, north London.

It comes after a 66-year-old man was found critically injured in the communal area of a block of flats in Lockhart Close.

Police were called to the scene just after 7.20pm on Friday.

Despite the efforts of emergency services, he was pronounced dead at the scene.

The man has not been formally identified but officers believe they know who he is and his next of kin have been informed.

A spokesperson for the Metropolitan Police said the man died after receiving “stab injuries”.

They added: “A significant number of enquiries have been carried out over the weekend, including house-to-house checks and a forensic examination of the scene.”

The woman was arrested on Sunday and is currently in custody at a north London police station, the force said.

Detective Chief Inspector Laura Nelson, who is leading the investigation, said: “Although an arrest has been made, it is vital that anyone with information about what happened on Friday evening comes forward to speak to us.

“I am also keen for anyone with a dashboard camera who was driving in Lockhart Close, Derby Road, Lincoln Road, or the surrounding area, to contact us immediately.”

Two boys, both aged 15, arrested on suspicion of murder over fatal stabbing of 16-year-old in Bristol | UK News

Two boys, both aged 15, have been arrested on suspicion of murder over the fatal stabbing of a 16-year-old boy in Bristol on Wednesday evening.

The 16-year-old, who has not been named, was attacked in the St Philips area, in Rawnsley Park.

He ran to Stapleton Road – where a driver helped him – before he collapsed on West Street.

Ambulances were called but he died at the scene, police said.

Supt Mark Runacres, Avon and Somerset Police’s Bristol Commander, said: “The team investigating yesterday’s incident are working around the clock to bring those responsible to justice.

“This evening (Thursday), two 15-year-old boys were arrested in connection with the investigation and they have been taken to police custody where they will be questioned.

“Our collective thoughts are with the victim’s family and loved ones during what is undoubtedly a very difficult time.

“Specialist family liaison officers have been assigned to the family to provide them with support and keep them updated on the investigation.”

Avon and Somerset Police said earlier that the tragedy was “a stark reminder of the horrific impact knife crime has on our communities”.

Marvin Rees, the mayor of Bristol, said his thoughts were with the victim’s family.

Posting on X, he said: “This needs to stop. We will make every effort to support the family, the police and local community at this time.”

The victim has not yet been officially identified and a post-mortem to determine the cause of death is due to take place, police added.

In the aftermath of the killing, police in the city have been given extra stop and search powers until 5pm tomorrow, but this could be extended.

The driver of a police van which was seen on CCTV following two boys on an e-bike shortly before they died in a fatal collision is facing a criminal investigation.

The Independent Office for Police Conduct (IOPC) said the driver of the vehicle was now being “criminally investigated for dangerous driving”.

The driver, along, with the passenger in the van, had previously been served with a gross misconduct notice.

Kyrees Sullivan, 16, and Harvey Evans, 15, died in the crash in the Ely area of Cardiff on 22 May.

The crash sparked riotous scenes in the community as properties were damaged and cars torched.

The IOPC said the notices and the criminal letter did not necessarily mean that disciplinary or criminal proceedings would follow.

The crash happened at 6.02pm on Snowden Road and CCTV footage showed the bike being followed by a police van at 6pm on nearby Frank Road.

Other footage showed the van turn off and it was not following the boys at the time of the collision.

The watchdog’s investigation is looking at the nature of the police’s interaction with the boys before the collision.

One key factor under consideration is whether there was any point at which the decision and actions of the officers in the van “constituted a pursuit”.

The IOPC has confirmed it has completed all its enquiries in the Ely area in recent weeks and has also reviewed footage from body-worn cameras.

South Wales Police is continuing to co-operate with the IOPC investigation.

‘Went everywhere together’

Following Harvey’s death, his family said their hearts were “truly broken”.

They described him as having lived “life to the full” and someone who had a “big heart”, adding that “deep down, he truly cared”.

His family also appealed for “peace within the community” and asked people to allow the police to investigate and “get the answers we so desperately need”.

Kyrees was a “handsome young man” and a “loving son and brother”, his family said.

They added that he and Harvey “went everywhere together” and were loved “not only by their families but by their community as well”.

IOPC Director David Ford said his thoughts and sympathies were with the family and friends of Kyrees and Harvey and everyone impacted by their deaths.

“Our independent investigation is progressing well and I want to again thank the local community for the support provided to our investigation, including through the sharing of CCTV evidence,” he said.

He said the IOPC said it remained “committed to establishing the facts” and would “continue to provide regular updates”.

Man charged over fatal dog attack in Derby as victim is named | UK News

A man has been charged under the Dangerous Dogs Act in connection with the death of another man at a house in Derby.

Wayne Stevens, 51, died after the incident at around 5.50am on Saturday in the Cavendish area of the city.

The dog was shot because it posed a risk to officers and to the public, police said.

Gary Stevens, 53, of Cameron Road, Derby, has been charged with being the person in charge of a dog dangerously out of control causing injury resulting in death.

He will appear at Southern Derbyshire Magistrates’ Court on Monday.

The force said: “Formal identification has taken place, and the victim has been named as 51-year-old Wayne Stevens.

“Our thoughts remain with his family and friends at this time.”

Second man charged over fatal doorstep shooting in Greenock | UK News

A second suspect has been arrested and charged in connection with the death of a man who was shot on his doorstep.

Neil Canney was seriously injured in an attack outside his house in Nairn Road, Greenock, Inverclyde, at around 1.15am on 28 February.

The 37-year-old was taken by ambulance to Glasgow’s Queen Elizabeth University Hospital, where he died a short time later.

On Monday, Police Scotland said a 28-year-old man had been arrested and charged in connection with the death.

A 22-year-old man was arrested and charged in connection with the incident on Friday.

The pair are due to appear at Greenock Sheriff Court today.

The O2 Academy in Brixton will remain shut for three more months after two people were killed in a crowd crush.

Owners Academy Music Group (AMG) said it had “reflected deeply” on the incident and had decided to stay closed regardless of an impending licensing decision by the local council.

Security guard Gaby Hutchinson, 23, and Rebecca Ikumelo, 33, were fatally injured when ticketless fans tried to enter Nigerian artist Asake’s show at the south London venue on 15 December.

Lambeth Council ordered the site to shut shortly afterwards, pending a hearing by a subcommittee on Monday.

Metropolitan Police had sought a longer licence suspension “to allow time to work with the venue to facilitate a safe reopening and to ensure appropriate safeguards, aimed at improving public safety, are in place”.

AMG has now taken the matter into its own hands, saying it “recognises the gravity” of what happened and offered “sincere condolences to the families of those who died”.

The three-month closure will give time for investigations into the incident to take place, AMG said, adding it was “committed to understanding what happened” and “providing full co-operation to the police”.

“The company’s decision to close for this period will be the case whether or not the licence is suspended, but AMG agrees to the suspension as an enforceable measure,” a statement continued.

An online portal set up by the Met for people to submit details, photos, and videos of the incident remains open.

Some 4,000 people are thought to have witnessed the crush, which left eight attendees needing hospital treatment.

Cody Fisher: Police issue appeal over fatal stabbing of footballer in Birmingham nightclub as friend says ‘I love you forever’ in tribute | UK News

Police have issued a fresh appeal for information about the alleged murder of footballer Cody Fisher as a friend paid tribute to him, begging for him to come home.

Mr Fisher, 23, was stabbed on the dancefloor of the Crane nightclub in the Digbeth area of Birmingham just before 11.45pm on Boxing Day.

Despite efforts to save him, he was pronounced dead around half an hour later. A murder investigation has been launched.

One of his friends, Jess Chatwin, paid tribute to the footballer on Twitter, in a tweet that is no longer public.

She wrote: “You didn’t deserve any of this. I’m so sorry this has happened to you my baby please come home. I love you forever Cody Fisher.”

She also wrote in her Instagram bio: “Love you forever my code”.

West Midlands Police wrote on Twitter: “Detectives have been working through the night and the investigation continues.

“We’re really pleased with the response so far, but are still appealing for people to get in touch who saw/recorded what happened.”

They included a link to submit information and photos or video footage.

In the appeal, they say no one has been arrested so far.

Detective Inspector Michelle Thurgood, who is leading the investigation, said in a statement on the West Midlands Police page: “This was a young man enjoying himself with friends on a Boxing Day night out and our thoughts are with his friends and family today.

“We know there were hundreds of people in the nightclub at the time. While we’ve spoken to a number of them already, we still need to hear from anyone who was there and who witnessed or even filmed what happened.

“We believe that the victim was approached by a group of people, and was then stabbed, so we’re working hard to identify all of those involved.”

Mr Fisher’s family said in a statement: “They have broken our hearts; I have lost my best friend. My family and I are asking for privacy and respectfulness at this heart-breaking time.”

Mr Fisher played for Stratford Town FC, who are in the Southern League Premier Division Central. He had also played for Bromsgrove Sporting.

Stratford Town’s chairman, Jed McCrory, told Sky News that “everyone is devastated by the news” and described Mr Fisher as a “talented footballer” and a “lovely, lovely young man”.

One of Mr Fisher’s friends, who played with him last season at Bromsgrove, told Sky News: “He was genuinely one of the nicest people you could hope to meet. He’d do anything for you.”

‘Speechless’: Tribute to Cody Fisher

The club released a statement and described Mr Fisher’s death as a “tragic loss”, adding: “Our sincere condolences go to the family and friends of Cody.”

They said they were “deeply shocked and saddened” by the incident and added that the club’s New Year’s Eve event has been cancelled.

Detectives are viewing CCTV from the venue and urge anyone who was in the area to get in touch. The club will remain closed while evidence is collected, and police will remain in the area.

Two more teenagers arrested over fatal stabbings of Charlie Bartolo and Kearne Solanke in southeast London | UK News

Two more teenagers have been arrested over the fatal stabbings of two 16-year-old boys in southeast London.

Police detained the suspects, aged 15 and 16, following the killings of Charlie Bartolo and Kearne Solanke in two separate incidents about a mile apart at the weekend.

Charlie was found with stab wounds in Sewell Road, Abbey Wood, at around 5.10pm on Saturday, with Kearne discovered with similar injuries in Titmuss Avenue, Thamesmead, at around the same time.

Another 16-year-old who was previously arrested on Sunday on suspicion of both murders has been released on bail pending further enquiries.

Detective Chief Inspector Kate Blackburn said: “My officers are working around the clock to establish the circumstances of these senseless murders and to find those responsible.”

She added that the force is investigating a “number of lines of enquiries” and she is “keeping an open mind about any motive”.

“The arrests are a positive development, but we continue to work to understand the events that unfolded on Saturday evening,” she said.

‘Help us bring justice for these young boys’

The Met Police have appealed for anyone with information on the incidents to come forward, specifically those who saw a black Nissan Qashqai with silver roof bars in either area in the days or hours before the murders.

“We have the vehicle in our possession, but are still interested in witnesses who may have seen it being driven locally. Information you provide could help us bring justice for these young boys and their families,” DCI Blackburn added.

Detective Superintendent Richard McDonagh, from the South East Command Unit, assured the local community that officers will “work tirelessly” to discover what happened and urged people to continue working together to “prevent such tragedies” in the future.

The families of Charlie and Kearne are being supported by specialist officers.
